Content notice (DSA Art. 16)

1. Purpose and legal basis
This policy describes the notice and action mechanism implemented by Trinqo in accordance with Article 16 of Regulation (EU) 2022/2065 on a single market for digital services (Digital Services Act, DSA).
Trinqo hosts user-generated content (UGC) accessible publicly (tastings shared via a public link). Any user or visitor may notify Trinqo of content they consider to be potentially illegal under Union law or applicable national law.
2. Who can report
In accordance with Article 16 of the DSA, the reporting mechanism is open to any individual or entity: registered Trinqo user, non-registered visitor, public authority or trusted flagger. No prior identification is required, but the reporter may voluntarily provide an email address to receive a reasoned response.
3. How to report
Three channels are available:
- "Report" button on the content page: every public UGC page (shared tasting) displays a Report button in the footer. The form pre-fills the content type and identifier.
- Dedicated email: send an email to privacy@trinqo.app with the URL of the content, the reason category and the detailed motivation. Attach any useful evidence (screenshot, reference link).
- Single point of contact (DSA Art. 11): for public authorities and trusted flaggers, info@trinqo.app.
4. Processing times
Trinqo undertakes to handle each report diligently, with a target of 7 business days from receipt, and no later than 30 days save for duly documented complexity.
Manifestly unfounded or abusive reports (spam of reports) are dismissed after a quick examination. An anti-abuse mechanism limits to 3 reports per hour and per IP address.
5. Response and action taken
After examination, Trinqo takes one of the following decisions and provides reasons to the reporter if an email was provided:
- Removal of content: if the content infringes applicable law or Trinqo's terms, the content is made inaccessible (URL 404) and the content author is notified.
- Maintenance of content: if the examination concludes the content is compliant, the report is closed without action and the reasoning is communicated to the reporter.
- Referral to authorities: in case of suspicion of serious criminal offence (minors, terrorism, organised fraud), Trinqo refers without delay to the competent authorities (DSA Art. 18).
6. Right of appeal
Both the reporter and the content author have a right of appeal against Trinqo's decision:
- Internal complaint: by email to privacy@trinqo.app stating the ticket reference. Trinqo reviews the complaint within 14 days.
- Out-of-court dispute settlement (DSA Art. 21): bodies certified by the national Digital Services Coordinator.
- Judicial remedies: competent courts in Belgium (Terms Art. 12) or in the consumer's Member State of residence.
7. Categories of prohibited content
The following are considered prohibited content on Trinqo, without prejudice to applicable law:
- Spam and off-topic content: unsolicited advertising, parasitic referral links, content unrelated to wine tasting
- Hate speech: discriminatory statements based on origin, religion, gender, sexual orientation or any other protected criterion
- Illegal content: any content infringing the criminal law of the Union or applicable national law
- Minor in connection with alcohol: photograph of a minor (under 18) associated with the consumption or promotion of alcohol
- False medical claim: assertion of a scientifically unproven health benefit attributed to an alcoholic beverage
- Non-compliant alcohol advertising: violation of the French Loi Évin (FR L.3323-2 et seq.), missing health warning or manifest incitement to excessive consumption
- Other: defamatory content, infringement of third-party rights (copyright, image rights), identity theft
8. Single point of contact (DSA Art. 11)
Trinqo designates as single point of contact for public authorities and trusted flaggers:
